K Wellness operates a wellness and beauty center in New York City offering services that may include, without limitation: therapeutic and relaxation massage; acupuncture and related modalities (including electro-acupuncture where offered); facial and skincare treatments; fusion massage and acupuncture programs; active restoration / rehabilitation-oriented therapy; cupping and related bodywork where offered; aesthetic medicine or medical-spa style services when provided by appropriately licensed clinicians; consultations; and retail or take-home products when available.

You represent that you are at least 18 years of age, or that you are a parent or legal guardian booking or accompanying a minor and accepting these Terms on the minor’s behalf. Certain Services may have additional age, health, pregnancy, or eligibility requirements. You represent that information you submit is true, accurate, and complete, and that you have authority to use any payment method you provide.
Our Site and Services are intended to support wellness, recovery, relaxation, and aesthetic or therapeutic goals. They are not a substitute for emergency medical care, hospital care, or ongoing primary care from your physician. If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately. Always consult your licensed healthcare provider regarding diagnosis, treatment decisions, medications, and whether a Service is appropriate for you.
Where a Service requires a New York State license (for example, acupuncture, massage therapy, physical therapy, medicine, or esthetics as applicable), that Service is provided only by individuals holding the required license(s) and practicing within their lawful scope. Availability of specific modalities, practitioners, and packages may change. We may decline, modify, postpone, or discontinue a Service based on professional judgment, contraindications, incomplete health information, safety, capacity, or applicable law.
Before certain Services, you may be asked to complete intake forms and sign informed-consent or acknowledgment documents. You agree to disclose accurate information about your health history, medications, allergies, pregnancy or nursing status, implants, recent procedures, skin conditions, pain, neurological issues, and any other facts that may affect eligibility or safety. Withholding or misrepresenting material health information may increase risk and may result in refusal or termination of Services without refund where permitted by law and our policies.
Appointments may be scheduled online (including through our booking tools), by phone, by text where offered, or in person. Please arrive early enough to check in and complete any required forms. If you arrive late, your session may be shortened so subsequent guests are not delayed, and you may still be charged for the originally scheduled Service. We reserve the right to reschedule or cancel appointments due to practitioner availability, facility conditions, weather, safety, or operational needs, and will use reasonable efforts to notify you using the contact information you provided.
Please cancel or reschedule as early as possible. Unless a specific offer, package, or written confirmation states otherwise, we ask for at least 24 hours’ notice for cancellations or rescheduling. Late cancellations and no-shows may result in a fee, forfeiture of a prepaid session credit, or loss of promotional pricing, as disclosed at booking or at the center. Repeated late cancellations or no-shows may affect future booking privileges. Gift cards, packages, and special offers may include additional rules printed on the offer or confirmation.
Prices for Services, packages, memberships (if any), retail items, and special offers are as stated at the time of purchase or booking, subject to correction of obvious errors. Payment is generally due at the time of Service unless other arrangements are confirmed in writing. We may require a card on file or deposit to hold certain appointments. You authorize charges consistent with these Terms and any cancellation policy disclosed to you. Insurance participation, if any, varies by service and plan; you remain responsible for non-covered amounts, deductibles, coinsurance, and administrative fees unless we expressly agree otherwise in writing.
Prepaid packages and promotional credits are subject to expiration, transfer, and usage rules stated at purchase. Unless required by applicable law, fees for Services already rendered are generally non-refundable. If a Service cannot be completed for clinical or safety reasons after it has begun, we will address the situation in good faith consistent with our policies and applicable law.
Special offers, sales, complimentary consultations, and limited-time promotions are subject to stated conditions, blackout dates, eligibility limits, and availability. We may modify or end promotions at any time. Offers cannot be combined unless expressly stated. Misuse of promotions may result in cancellation of the booking or adjustment to regular pricing.
Where gift cards or certificates are offered, they are redeemable for eligible Services or products as stated on the card or at purchase. Lost, stolen, or unauthorized cards may not be replaced except as required by law. Expiration, residual value, and cash redemption rules follow New York and other applicable law.
You agree to treat staff and other guests with respect. We may refuse or discontinue Service, and may ask a guest to leave, if we reasonably believe there is intoxication, harassment, unsafe behavior, refusal to follow safety instructions, or other conduct that compromises the experience or safety of others. Photography or recording of other guests or staff without consent is prohibited. Commercial photography requires prior written permission.
You agree not to misuse the Site, including by attempting unauthorized access; scraping in a manner that impairs operations; uploading malware; submitting false booking or employment information; interfering with other users; or using the Site for unlawful purposes. We may suspend or terminate access for violations. Site content (text, images, logos, design, and trademarks) is owned by K Wellness or its licensors and may not be copied for commercial use without permission, except as allowed by fair use or other non-waivable rights.
If you create an account or receive appointment confirmations, reminders, or marketing messages, you are responsible for safeguarding credentials and for activity under your account. You may opt out of marketing communications as described in our Privacy Policy. Transactional messages related to bookings, safety, or account administration may still be sent where permitted by law.

The Site may use third-party services (for example, booking, payments, reviews, analytics, accessibility tools, or maps). Those services are governed by their own terms and privacy policies. We are not responsible for third-party sites or tools we do not control.

TO THE FULLEST EXTENT PERMITTED BY LAW, K Wellness AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SITE OR A PARTICULAR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR, IF GREATER AND REQUIRED BY LAW, THE MINIMUM AMOUNT THAT CANNOT BE LIMITED). Nothing in these Terms is intended to exclude or limit liability for gross negligence, willful misconduct, or other liability that cannot be limited under applicable law, or to limit rights you may have regarding professional malpractice claims to the extent such rights cannot be waived.
To the fullest extent permitted by law, you agree to indemnify and hold harmless K Wellness and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your breach of these Terms, or your provision of inaccurate health or booking information, except to the extent caused by our willful misconduct or as prohibited by law.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles that would require another jurisdiction’s law. Subject to any non-waivable rights, exclusive venue for disputes arising from these Terms or the Site that are resolved in court shall lie in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
We may update these Terms from time to time by posting a revised version on the Site with an updated effective date. Continued use of the Site or Services after changes become effective constitutes acceptance of the revised Terms, except where additional consent is required by law. Material changes affecting booked Services may also be communicated by email, text, or notice at the center when practicable.
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, User Agreement, Disclosure page, and any signed consents or service-specific policies, constitute the entire agreement between you and us regarding the Site and the general terms of Services, and supersede prior conflicting online statements, except that a signed service-specific consent controls for the Service it covers if there is a direct conflict.
